(1) These General Terms and Conditions (referred to hereinafter as T&Cs) shall apply to all contracts concluded between EATRENALIN Rust/Germany GmbH & Co. KG, Europa-Park-Str. 2, 77977 Rust (referred to hereinafter as the “Organizer”, “we” or “us”) and visitors to EATRENALIN, Roland-Mack-Ring 5, 77977 Rust (referred to hereinafter as the “Buyer”, “Guest” or “you”), said contracts usually being concluded online, and in exceptional cases on site.
The T&Cs apply regardless of whether you are a consumer, an entrepreneur or a merchant.
(2) All agreements made between you and us in connection with the contract shall be in accordance with these terms of sale, in particular.
(3) The current version of the T&Cs at the time of concluding the purchase contract shall be definitive.
(4) We do not accept any terms and conditions of the Buyer which deviate from these T&Cs. This shall also apply if we have not expressly objected to their inclusion.
(1) You purchase your personalized, date- and time-specific ticket from us online, for instance at https://eatrenalin.com/, by telephone or on site at the Europa-Park Resort. When purchasing a ticket, the Buyer must provide specific data for the purposes of identifying the Guest for whom the ticket is purchased. This includes information on allergies or intolerances. Nutritional preferences and intolerances which have not been specified when booking cannot be taken into account during the experience. A name must also be supplied as part of the ordering process for the purposes of seat allocation. Invented names may also be used here.
(2) The Contract is concluded upon our acceptance of the order. The order is accepted by means of the e-mail confirming the order which is sent to the e-mail address specified by ordering party. When purchasing on site, you will be issued directly with a digital or printed ticket.
(3) You will receive your digital ticket upon conclusion of the purchasing process.
(4) Irrespective of the fact that the ticket is offered via telecommunication media, meaning that a distance selling contract may be deemed to have concluded, the Buyer shall not be entitled to a statutory right of rescission when purchasing an EATRENALIN ticket. A right to cancellation and refund within a two-week period shall not apply. Any offer submission for or order of EATRENALIN tickets shall thus be binding and oblige the Buyer to accept and pay for the tickets, immediately upon confirmation by us.
(5) The contract shall be concluded in the German language. Even if the wording of the contract is to be translated into another language, the German wording shall remain binding.
(1) The subject matter of the contract is the purchase of a personalized ticket for a specific date, affording the Buyer one-time admission to EATRENALIN. The ticket includes food and beverages (unless otherwise specified) in the context of a multimedia entertainment programme. A visit to the bar is not included in the service, unless the appropriate add-ons are booked.
(2) As part of the purchasing process, you must select a specific date and time for your visit to EATRENALIN, which will be binding for the ticket. Please arrive promptly at the time stated on the ticket. There is no need to arrive long before that. We recommend arriving at the location 30 minutes before the event. Waiting times at the attraction are possible. We will endeavour to enable ticket holders who arrive late to participate, but this cannot be guaranteed.
(3) No refunds will be issued if the guest fails to turn up or if a purchased add-on is not redeemed on the booked date.
(4) In exceptional cases, we reserve the right to change guests’ bookings on site to another time slot on the day of their visit.
(5) Guests will only be granted access to EATRENALIN after presentation of a valid personalized ticket. Eligibility will be verified. Guests must ensure that their ticket is legible. We reserve the right to verify the validity of the ticket and/or ID at any time.
(6) Reduced tickets can only be purchased if the reason for the reduction still applies and evidence can be furnished at the time of purchase. Failing this, the Buyer has no right to a reduction and must pay the difference between the reduced price and the regular price.
(7) The personalized implementation of the contract such as the welcome e-mail, invoices and indications of changes to the contract will be sent to the e-mail address specified upon the purchase of the ticket. The Buyer shall be responsible for regularly checking his/her account for e-mails. The Buyer shall be responsible for ensuring that he/she has access to the e-mail address supplied and for notifying us of any changes in e-mail address. Buyers furthermore have the option of registering for a personalized Europe-Park newsletter.
(8) The ticket is personalized and non-transferable. Only the person whose data has been registered is entitled to use it. The ticket may not be passed on to third parties. Should a third party attempt to use a ticket registered for another person, they shall not be granted admission to EATRENALIN and the ticket shall be invalidated without recompense.
(9) A specific number of tickets is available for each time slot of the event. The operating hours will be specified by the Organizer.
(10) Ticket Buyers shall be obliged to reserve a ticket for a specific date online prior to their visit. The number of tickets reserved simultaneously is limited to 16 in the case of online bookings.
(11) The commercial resale of tickets for EATRENALIN is prohibited.
(1) If a temporary suspension of service at EATRENALIN is required for technical, organisational, operational or weather-related reasons not attributable to intent or gross negligence on the part of the Organizer, ticket holders shall not be entitled to a full or partial refund of the ticket price.
(2) In the event that the Buyer is informed of cancellation at short notice prior to the start of the event, the ticket shall remain valid and be rebooked for a new date. Further claims for damages shall be excluded.
(3) In the case of longer-term, unplanned closures (generally in excess of one week) we may decide at our discretion whether the purchased ticket is to be exchanged or refunded. Further claims for damages shall be excluded.
(4) It may become necessary to limit the permissible number of visitors to EATRENALIN, for instance in response to official requirements or for safety reasons. The number of tickets available for EATRENALIN for a specific date is limited to a fixed quantity specified by us. There is therefore no guarantee that reservations will be possible. Reservations will be handled in the order in which they are received.
(1) In the event that vouchers and/or tickets are lost, the Organizer shall only perform the booked service if the identity of the Buyer can be clearly verified and the voucher/ticket has not yet been used. Failing this, the Buyer shall not be entitled to redeem the voucher or ticket.
(2) The loss of a ticket must be reported to info@eatrenalin.com without delay. Buyers are liable for the loss of their ticket. It is generally possible to request the issue of a replacement ticket for a fee.
(1) We recommend a minimum age of 10 years for participation, provided an adult is accompanying the child. Since the chairs are not suitable for small children, a child should be able to sit independently and without support for about 90 minutes.
(2) Information on food intolerances is requested at the time of booking. The Buyer must specify these in full when making the booking.
(3) People suffering from photosensitive epilepsy or similar conditions may not participate for safety reasons.
(4) Guests shall be obliged ensure that they are in sufficiently good health prior to participating, to inform themselves about the risks and to acknowledge and adhere to the terms of use and rules of access as well as the safety rules and regulations. The Organizer shall be entitled to exclude individual persons from use of EATRENALIN for safety reasons e.g. due to their height, build, physical or mental disabilities, permanent or temporary disabilities, pregnancy etc. Exclusion for safety reasons does not constitute discrimination, but is merely intended to safeguard the health and safety of Guests.
(5) Guests are requested to exercise due caution during the entire event. Always follow the instructions given by the EATRENALIN employees. If such instructions are not followed or if they are wilfully disregarded, the person involved will be excluded from participation. In the event of an infringement or in cases of repeated infringements, such persons may be expelled from the place of participation. They are not entitled to a refund in such cases.
(6) During the experience, Guests may only stand up at will in an emergency. Guests must use the service button if they want to stand up and then follow the employees’ instructions. Any Guest who temporarily or permanently leaves the experience for personal reasons shall not be entitled to subsequent performance of any services missed.
(7) The Guest shall inform employees without undue delay in the event of any problems which may impair safety, particularly technical problems.
(8) All visitors are required to dress appropriately and smartly. Only guests dressed elegantly and stylishly, in keeping with the ambience, will be admitted. Casual and streetwear are not permitted. For example, you will not be admitted to EATRENALIN if you are wearing shorts or open-toed shoes (for men), T-shirts, flip-flops, jogging trousers, ripped jeans or unkempt clothing. In such cases, the ticket price will not be refunded.
(1) The statutory warranty rights shall apply with respect to any defects.
(2) The instructions issued by EATRENALIN staff must be followed without fail at all times in order to ensure safety. The applicable conditions and safety regulations must be observed when attending the event.
(3) We are liable to you for damages or compensation of wasted expenses in accordance with statutory provisions in cases of contractual and non-contractual liability involving wilful intent and gross negligence.
(4) In other cases, we are only liable insofar as a contractual obligation has been breached, the fulfilment of which is essential to the due and proper implementation of the contract and upon the fulfilment of which you, the Buyer, generally rely and may rely (material contractual obligations), said liability only extending to damage which is typical of the contract and foreseeable. In all other cases, our liability shall be excluded, except as provided in Para 3.
(5) Our liability for damages arising from death, personal injury or health impairment and claims pursuant to Product Liability Law shall not be affected by the above limitations and exclusions of liability.
(6) Complaints about faulty tickets must be lodged without undue delay following receipt by e-mail or post. The complaint must be sent in text form to info@eatrenalin.com.
(1) All guests are strongly advised to behave in a correct and appropriate manner. The Organizer will take appropriate measures, e.g. issue a reprimand, report an offence to the police or similar, in response to any breach of the peace, wilful destruction to or fouling of property, improper conduct, disturbance of other guests or operation, verbal or physical abuse, defamation or insult, disregard of the terms of use etc. The Organizer additionally reserves the right to expel any guests from EATRENALIN without compensation in the event that their behaviour indicates that they may endanger themselves or others or that they may disturb others.
(2) The fire safety rules at EATRENALIN must be observed without fail. Smoking is prohibited in the building and waiting area. Please show consideration for others.
(3) Persons who are inebriated or are under the influence of drugs are prohibited from participating.
(4) Guests are prohibited from bringing their own food and beverages. The possession or consumption of illegal narcotics and paraphernalia for the consumption thereof is likewise prohibited. Failures to comply with the above will be punished accordingly. The same shall apply to the taking of medical cannabis products which are suitable for consumption by smoking into EATRENALIN, unless a medical prescription can be furnished to prove the necessity of possessing and carrying such products. The consumption of cannabis and cannabis products is not permitted at EATRENALIN.
(5) The possession and carrying of weapons, dummy weapons or dangerous objects such as firearms, sharp/pointed knives, chains, knuckle dusters, pepper spray, tasers, tools, large scissors, wires, crossbows, bows and arrows, blowpipes, catapults, baseball bats, fireworks or other pyrotechnical items and any manner of items which are discriminatory, unconstitutional or glorify violence are prohibited on the grounds of EATRENALIN.
(6) Guests may not access the designated scenery, backstage areas nor any service areas not expressly identified as accessible to them. Barriers, fences and walls may not be climbed over.
(7) Dogs are not permitted in the EATRENALIN building.
(1) CCTV cameras are in operation in the entrance area, in the car park and in the interior sections of EATRENALIN. These areas are kept under surveillance to ensure the safety of Guests and employees and to protect the facilities and equipment.
(2) Guests may not take their own photographs or make films for private purposes.
(1) Every Guest who would like to enter the building to use EATRENALIN expressly agrees to voluntarily submit to any checks conducted by the Europa-Park security service in individual cases. Participants must comply fully with the instructions issued by the security service or they will be denied access. The security service used is entitled to check whether people pose a safety risk due to alcohol/drug consumption or the carrying of weapons or dangerous objects. All Guests expressly agree to allow their clothing and any receptacles they are carrying to be searched for this purpose.
(2) The security service is entitled to deny persons who pose a safety risk access to the grounds.
(3) The same shall apply to any persons who do not consent to the searching of their clothing and the receptacles they have with them. The security service is furthermore entitled to seize any objects which are not in compliance with the above paragraph such as drugs, weapons etc.
(4) The security service is additionally entitled to search persons who have already entered the grounds.
(1) The rules and signs of the German Road Traffic Act (StVO) apply in our car parks.
(2) Visitors to EATRENALIN can park their vehicles in the designated visitors’ car park. Guests of Hotel Krønasår should please park in the parking spaces which are specially reserved for their use. Only employees of Europa-Park may use the employee car park
(3) The instructions issued by our employees in the car parks must be precisely followed to ensure a smooth flow of traffic. Vehicles may only be parked within the parking areas designated for this purpose. If a vehicle is not parked properly and causes an obstruction to traffic, the Organizer will be obliged to have the vehicle towed away at the expense and risk of the vehicle owner.
(4) The parking areas are not guarded by the Organizer. In this respect, the parking fee only covers the provision of a parking space and not the guarding of vehicles. When leaving their vehicles, Guests are requested to ensure that they have closed all windows and the sunroof and closed and locked the doors and boot. In their own interests, they are additionally requested to refrain from leaving valuables in view inside their parked car. Animals may not be left in parked vehicles.
(5) The Organizer will not be liable for theft of or damage to a vehicle by third parties. This shall also apply to damage caused by storm, fire, hail, explosion or any other exceptional circumstances. Any damage which the party involved believes to have been caused by Europa-Park employees must be reported to our staff immediately upon discovery and during their visit, insofar as this is reasonable. However, Europa-Park will only be liable for fault on the part of its employees in cases of intent or gross negligence.
(1) The law of the Federal Republic of Germany shall prevail to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
(2) We hereby point out that we are neither willing nor obliged to participate in a dispute resolution before a consumer arbitration board.
(3) If you are a merchant and your registered head office is in Germany at the time of purchase, Freiburg im Breisgau shall be the sole place of jurisdiction. The Organizer shall, however, be entitled to file suit at the registered head office or a branch of the Buyer. Rust shall be agreed to be the place of fulfilment for deliveries and payments. In other respects, the applicable statutory provisions shall apply with respect to the local and international jurisdiction.
(4) Should any provision of these General Terms and Conditions and/or any other agreements concluded be or become invalid, this shall not affect the validity of the remaining provisions.
The Organizer is entitled to expel persons who violate the terms of use at its own discretion, without compensation.
