General Terms and Conditions of Business for the Europa-Park ResortPass

1. Scope of application

(1) These General Terms and Conditions (hereinafter T&Cs) apply to all contracts usually concluded online and, in exceptional cases, on site at Europa-Park between Europa-Park GmbH & Co Mack KG, Europa-Park-Straße 2, 77977 Rust (hereinafter “Europa-Park”, “we” or “us”) and the buyers of a Europa-Park ResortPass (hereinafter “Holder” or “you”).

These T&Cs apply regardless of whether you are a consumer, an entrepreneur or a merchant.

(2) All agreements made between you and us in connection with the contract ensue from these terms of sale, in particular.

(3) The version of the T&Cs valid at the time of concluding the purchase contract or at the time of the most recent renewal of the ResortPass is decisive.

(4) We do not accept any deviating terms and conditions of the Holder. This also applies if we have not expressly objected to their application.

 

2. Conclusion of the contract

(1) A personalised ResortPass can be purchased from us online, e.g. at tickets.mackinternational.de/en/resortpass/overview. A MackOne account is required for the purchase. At the time of purchase, you must supply specific data for each ResortPass so that the holder of the respective ResortPass can be identified, e.g. gender, first and last name, date of birth, home address and a recent photograph. Only a limited number of ResortPass annual passes can be purchased per MackOne account.

(2) The contract is concluded upon our acceptance of the order. The order is accepted upon the sending of an e-mail confirming the order to the e-mail address specified by the ordering party.

(3) You will receive your ResortPass in the form of a QR code (digital pass) upon completion of the purchasing process. A printed pass is available for an additional charge.

(4) Irrespective of the fact that the ResortPass is offered via telecommunication media, meaning that a distance selling contract may be deemed to have been concluded, the Holder is not entitled to a statutory right of rescission when purchasing a ResortPass. A right to cancellation and refund within a two-week period therefore does not apply. Any offer submissions for or orders of ResortPass annual passes thus become binding immediately upon confirmation by us and the Holder is obliged to accept and pay for the passes.

(5) We reserve the right to sell the ResortPass on site in the form of a provisional ResortPass.

(6) The contract is concluded in the German language. Even if the wording of the contract is translated into another language, the German wording remains binding.

 

3. Subject matter of the Contract

(1) The subject matter of the contract is the purchase of a personalised ResortPass, giving the Holder access to a range of services for a period of one year from the start of the validity period. We offer the ResortPass Silver and the ResortPass Gold, each comprising a different selection of services. (2) During the purchasing process, you will be required to select a date for the start of validity of each ResortPass. This date must lie within the given time frame. The ResortPass is deemed to be activated upon commencement of the validity period. The start of the validity period can usually be selected up to a maximum of 14 days in advance.

(3) A ResortPass affords the Holder personal access to Europa-Park during opening hours on regular opening days for one year from the start of the validity period. On certain regular opening days, Holders of a ResortPass Silver are not entitled to use their annual pass to access Europa-Park. On these days, they must purchase a separate day ticket for a fee. For a list of the days on which this rule applies, go to: tickets.mackinternational.de/en/resortpass/overview. Additional costs may be incurred when visiting Europa-Park, for example parking fees.

(4) The Holder is not entitled to a renewal of a ResortPass or a guarantee of admission to Europa-Park. Particularly in the event of an excessive volume of reservations or in cases where the maximum number of visitors would be exceeded, we reserve the right to limit the fixed quantity of ResortPass Holders to be admitted at short notice. In such cases, admission may be limited. We recommend making a reservation in the ResortPass portal well in advance to ensure availability. In the event of misuse of the reservation option, e.g. by repeatedly making reservations and then failing to make use of them, Europa-Park reserves the right to block the ResortPass. Europa-Park also reserves the right to cancel any existing reservations in the event of misuse. In such cases, the ResortPass Holder will be informed of the cancellation by e-mail.

(5) Holders of a ResortPass are also granted exclusive additional vouchers and price reductions, some of which are communicated by e-mail. These can usually also be viewed online in the ResortPass portal. The advertised conditions apply to any special offers such as the Bring-your-Friend Programme. In the event of a breach of these conditions, e.g. the unauthorised sale of special offer tickets to third parties, we reserve the right to exercise a special right to terminate the ResortPass.

(6) Admission to and use of Europa-Park and the Rulantica water world are subject to the provisions of the Park Rules and/or of the Park and Bathing Rules and Regulations. These can be viewed at tickets.mackinternational.de/en/info/park-rules-europapark and tickets.mackinternational.de/en/info/park-and-bathing-rules-and-regulations-rulantica and are also displayed on site. We reserve the right to confiscate a ResortPass without replacement or recompense in the event of misuse by the Holder.

(7) A Holder will only be admitted to Europa-Park and/or Rulantica and granted any applicable price reductions for events if they present a valid ResortPass, a valid official photo ID and, in the case of events, a ticket for the event at the entrance. Eligibility is verified regularly. Holders must ensure that their ResortPass is legible. We reserve the right to verify the validity of the ResortPass and/or ID at any time.

(8) Unless indicated otherwise at the time of reservation, free reservations which are made in the Mack International Ticketshop in the ResortPass portal may be cancelled free of charge at any time up to the day before the reserved event in the “Orders/Reservations” section. Cancellations are only possible online via the ticket shop and cannot be made by e-mail or telephone.

(9) Concession ResortPass annual passes can only be purchased if the reason for the concession still applies and evidence thereof can be furnished at the time of activation and renewal. Failing this, the Holder is not entitled to a concession and must pay the difference between the concession rate and the normal rate.

(10) To validate the ResortPass, a recent digital photograph of the respective Holder must be uploaded at the time of purchase. This photograph is stored on our system for identification purposes. The photo must meet our technical specifications: The file must be at least 300 x 300 pixels and no more than 5 MB in size. The following file formats are accepted: .jpeg, .jpg or .png. Group photographs are not accepted. The photo must be in sharp focus and display a full frontal view of the face. The face must be clearly recognisable. Full-body images are not permitted. ResortPasses cannot be issued without a valid photo.

(11) Personalized contract processing, such as the sending of invoices, vouchers and the birthday e-mail or notices of changes to the contract will be sent to the e-mail address specified in the MackOne account. The Holder is responsible for regularly checking their account for incoming e-mails. The Holder is responsible for ensuring that they have access to the e-mail address supplied and for notifying us of any changes in e-mail address. Holders furthermore have the option of subscribing to the general Europe-Park newsletter.

(12) The validity period of the ResortPass and any discounted tickets or vouchers linked to it can be viewed in the Holder’s MackOne account. Any unclaimed vouchers expire at the end of the 12-month validity period of the ResortPass.

(13) The ResortPass is personal and non-transferable. Only the person whose data and photograph have been registered for the ResortPass is entitled to use it. The ResortPass may not be passed on to third parties. In the event that a third party who is not the registered Holder attempts to use a ResortPass, we reserve the right to confiscate the Holder’s ResortPass, ban them from Europa-Park, claim damages from them and charge them for the administrative costs incurred.

(14) Holders may additionally purchase a ParkingPass, subject to availability and for a fee. The ParkingPass is also personal and non-transferrable and is linked to a specific ResortPass. It entitles the Holder to park their car in the regular Europa-Park and Rulantica car parks during their visit to Europa-Park and/or Rulantica. The validity period of the ParkingPass is concurrent with that of the linked ResortPass.

(15) We deem the owner of the MackOne account used to purchase a ResortPass to be the Holder of that pass, unless the owner of the MackOne account has specified otherwise. Any refunds will be paid to the Holder.

(16) We reserve the right to limit the number of ResortPass annual passes and ParkingPasses that are available for purchase. A ResortPass cannot be upgraded or downgraded during its validity period.

(17) ResortPass Holders are obliged to reserve a dated ticket online prior to their visit. The number of day tickets that may be reserved at the same time is limited to five per ResortPass.

(18) We reserve the right to block individual ResortPass annual passes if they are reported stolen and in the event of attempted fraud or breaches of these T&Cs. Requests to unblock a blocked ResortPass should be directed to info@resort-pass.de. If the Holder is responsible for the blocking of the ResortPass, they will not be compensated for the period of the block.

 

4. Closures of Europa-Park or admission restrictions

(1) Short-term closures of Europa-Park or Rulantica for which we are not responsible do not entitle the Holder to claim compensation or an extension of the validity period of the ResortPass.

(2) In the case of longer-term and unplanned closures (generally of over one week) we may, at our own discretion, choose to extend the validity period of the respective ResortPass by a number of days equal to the duration of the unplanned closure or to terminate the ResortPass and pay out its residual value based on its remaining validity period.

The amount paid out is based on the exact number of remaining days of validity of the respective ResortPass. A total validity period of 365 days is applied here.

These provisions also apply to the ParkingPass. Payouts can only be made if the Holder has supplied us with the necessary bank details for a refund by bank transfer.

(3) It may become necessary to limit the permissible number of daily visitors to Europa-Park or Rulantica, for instance in response to official requirements or for safety reasons. In the event that Europa-Park opens subject to such capacity restrictions, ResortPass Holders will also be required to reserve a dated ticket online prior to their visit. They will not be admitted without such a ticket. In such exceptional cases, we reserve the right to limit the number of dated tickets that will be made available to ResortPass Holders to a quantity specified by us. There is therefore no guarantee that reservations will be possible. Reservations will be handled in the order in which they are received. 

(4) In the event that official or statutory admission restrictions are imposed and compliance therewith lies within the Holder’s sphere of influence (e.g. regarding vaccination status or testing obligations), the Holder is not entitled to assert claims against Europa-Park if they are prevented from visiting Europa-Park due to their personal inability to meet the applicable requirements.

(5) Insofar as a Holder reserves a dated ticket and fails to make use of it, their ability to reserve further tickets may be restricted for the following 14 days.

 

5. Loss of ResortPass annual passes

(1) In the event that vouchers and/or admission tickets are lost, Europa-Park will only provide the booked service if the identity of the Holder can be clearly established and the voucher has not yet been used. Failing this, the Holder has no legal entitlement to a redemption of the voucher or ticket.

(2) The loss of a printed ResortPass must be reported to info@resort-pass.de without delay. Holders are liable for the loss of their ResortPass. It is generally possible to request the issue of a replacement for a fee.

 

6. Warranty and liability

(1) The statutory warranty rights apply with respect to any defects.

(2) The instructions issued by Europa-Park and Rulantica staff must be followed without fail at all times within the parks and at the respective attractions in order to ensure safety. When attending an event, the applicable conditions and safety regulations must be observed.

(3) We are liable to you for damages or compensation of wasted expenses in accordance with statutory provisions in cases of contractual and non-contractual liability involving wilful intent and gross negligence.

(4) In other cases, we are only liable insofar as a contractual obligation has been breached, the fulfilment of which is essential to the due and proper implementation of the contract and upon the fulfilment of which you, the Holder, generally rely and may rely (material contractual obligations), said liability only extending to damage which is typical of the contract and foreseeable. In all other cases, our liability is excluded, subject to the provisions in Para 3.

(5) Our liability for damages arising from death, personal injury or health impairment and claims pursuant to Product Liability Law remain unaffected by the above limitations and exclusions of liability.

(6) Complaints about faulty ResortPass annual passes must be lodged without undue delay following receipt by e-mail or post. In principle, the complaint must be sent in text form to info@resort-pass.de. Complaints may also be lodged by other means (e.g. by fax or by post), however this may lead to delays in processing. 

 

7. Applicable law and place of jurisdiction

(1) The law of the Federal Republic of Germany prevails to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

(2) We hereby point out that we are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

(3) If you are a merchant and your registered head office is in Germany at the time of purchase, Freiburg im Breisgau is the sole place of jurisdiction. However, Europa-Park is also entitled to take legal action at the location of the Holder’s registered head office or branch. Rust is agreed to be the place of fulfilment for deliveries and payments. In other respects, the applicable statutory provisions apply with respect to local and international jurisdiction.

(4) Should any provision of these General Terms and Conditions and/or any other agreements concluded be or become invalid, this will not affect the validity of the remaining terms and conditions.

General Terms and Conditions of Business for the Europa-Park ResortPass (Last updated: March 2022)

1. Scope

(1) These General Terms and Conditions of Business (hereinafter: GTC) apply to all contracts concluded, as a rule, online or exceptionally on site at Europa-Park between Europa-Park GmbH & Co Mack KG, Europa-Park-Strasse 2, 77977 Rust (hereinafter "Europa-Park", "we" or "us") and the buyers of a Europa-Park ResortPass (hereinafter “holder" or "you").

These GTCs are applicable regardless of whether you are a consumer, entrepreneur or merchant.

(2) All agreements made between you and us in connection with the contract arise out of these terms and conditions of sale in particular.

(3) The version of the GTC valid at the time of conclusion of the purchase contract or at the time of conclusion of the last renewal of the ResortPass is decisive.

(4) We do not accept deviating conditions of the holder. This also applies even if we do not expressly object to the application of such terms and conditions.

 

2. Conclusion of the contract

(1) You can buy your personalised ResortPass from us online, e.g. at tickets.mackinternational.de/en/resortpass/overview. A MackOne account is required for the purchase. When purchasing, you must enter certain data for each ResortPass that serve to identify the respective ResortPass holder, such as gender, first and last name, date of birth, home address and a current photo. The number of ResortPass annual passes per MackOne account is limited.

(2) The contract is concluded with the acceptance of the order by us. The acceptance takes place by e-mail in which the order is confirmed to the e-mail address provided by the customer.

(3) After completing the purchase process, you will receive your ResortPass as a QR code (“digital ticket"). A printed ticket may be available at an additional cost.

(4) Even if the ResortPass is offered by means of distance communication and thus a distance contract may exist, there is no statutory right of withdrawal when purchasing a ResortPass. This means that there is no two-week right of withdrawal and return. Every offer or order of ResortPass annual passes is therefore binding immediately after confirmation by us and obligates to acceptance and payment.

(5) We reserve the right to sell the ResortPass on site in the form of a temporary ResortPass.

(6) The contract is concluded in German. Even if the contract text is translated into another language, the German contract text remains binding.

 

3. Subject matter of the contract

(1) The subject of the contract is the purchase of a personalised ResortPass, with which the holder receives different services for a period of one year from the beginning of validity. We offer the ResortPass Silver and the ResortPass Gold which comprise different services. An overview of the services can be found here: tickets.mackinternational.de/en/resortpass/overview.

(2) In the purchase process, you must determine the beginning of the validity of the respective ResortPass within a specified time window. With the beginning of validity, the ResortPass is considered activated. The start of validity can usually be selected a maximum of 14 days in advance.

(3) A ResortPass entitles the holder personally to access Europa-Park for one year from the beginning of its validity on the regular opening days during the opening hours. With the ResortPass Silver there are certain regular opening days on which the holder cannot visit Europa-Park. For these days a separate day ticket would have to be purchased for a fee. You will find information about which days these are here tickets.mackinternational.de/en/resortpass/overview. There is no entitlement of the holder to a renewal of a ResortPass or a guarantee of access to Europa-Park. There may be additional costs during a visit, such as for the parking lot.

(4) A ResortPass also comprises the offer of exclusive additional vouchers and discounts, some of which are sent by e-mail and can usually also be viewed online in the ResortPass portal.

(5) Access to and use of Europa-Park and the water world Rulantica are subject to the rules of the Park Regulations and the Park and Bathing Regulations, respectively. This can be viewed under tickets.mackinternational.de/en/info/park-rules-europapark and tickets.mackinternational.de/en/info/park-and-bathing-rules-and-regulations-rulantica, as well as on site. We reserve the right to withdraw the ResortPass without replacement in case of misuse by a holder.

(6) The holder will only receive access to Europa-Park, Rulantica and, if applicable, discounts for events upon presentation of his or her valid ResortPass, valid official photo ID and, for events, the event ticket at the entrance. The authorisation is checked regularly. The readability of the ResortPass must be ensured by the holder. We reserve the right to check the ResortPass and/or identity document at any time.

(7) Discounted ResortPass annual passes can only be purchased if the reason for the discount still exists at the time of activation and renewal and can be proven. Otherwise, there is no right to discount and the holder will have to pay the difference between the discounted and the normal price.

(8) In order to validate the ResortPass, a current digital photo of the respective holder must be uploaded at the time of purchase, which will be stored in our system for identification. The photo must meet our technical specifications. It is not possible to issue a ResortPass without a photo.

(9) Personalised contract processing, such as the sending of invoices, vouchers and the birthday e-mail or notices of contract changes, are carried out via the e-mail address specified in the MackOne account. The holder is responsible for regularly checking his or her e-mail account for e-mails. He or she is responsible for having access to the e-mail address provided and for notifying us of changes to the e-mail address. Owners also have the opportunity to subscribe to the general newsletter of Europa-Park.

(10) The duration of the ResortPass and, if applicable, discount tickets or vouchers associated with the ResortPass can be viewed in your MackOne account. After the end of the respective term of 12 months of the ResortPass, any vouchers that may still be available will also expire.

(11) The ResortPass is personal and non-transferable. Only those whose data and photo are registered for the ResortPass are entitled to use it. The Pass must not be passed on to third parties. If a third party tries to use a ResortPass and is not the person registered for this ResortPass, we reserve the right to withdraw the ResortPass, prohibit the holder of the ResortPass from entering our premises, to claim damages and charge the administrative costs incurred.

(12) Holders also have the option of purchasing a paid ParkingPass, subject to availability. This is also personalised, non-transferable and is linked to a ResortPass. It entitles you to park a car in the regular parking lots of Europa-Park and Rulantica during your stay in Europa-Park or Rulantica. The duration of the ParkingPass is linked to that of the associated ResortPass.

(13) For us, the holder of the ResortPass is the owner of the MackOne account through which the respective pass was purchased, unless the owner of the MackOne account has informed us otherwise. Possible refunds will be made to the holder.

(14) We reserve the right to limit the number of ResortPass annual passes and ParkingPasses to be sold. An upgrade or downgrade of the respective ResortPass is not possible during the term.

(15) ResortPass holders are obliged to reserve a ticket for a specific day online before their visit. The number of day tickets reserved at the same time is limited to five tickets per ResortPass.

(16) We reserve the right to block individual ResortPass annual passes in the event of reported thefts, fraud attempts or violations of these terms and conditions of business. The cancellation of a block can be requested via info@resort-pass.de. In the case of a block caused by the holder, no compensation will be made for the period of the block.

 

4. Closures of Europa-Park or restrictions

(1) Short-term closures of Europa-Park or Rulantica, for which we are not responsible, do not lead to claims for compensation by the holder or to claims for an extension of the ResortPass term.

(2) In the case of longer and unplanned closures (usually over a week), we have the choice whether the respective ResortPass is extended by the number of unplanned closing days or is cancelled and we pay out the residual value of the ResortPass depending on the term.

The value of the payout is based on the remaining term of the respective ResortPass, exactly to the day. A term of 365 days is scheduled.

These regulations also apply to the ParkingPass. A payment can only be made when the holder has provided us with the necessary bank details for a remittance.

(3) It may be necessary, inter alia, due to official requirements or for safety reasons, to limit the permissible number of daily visitors to Europa-Park or Rulantica. With such a capacity-limited opening, it is also necessary for ResortPass holders to reserve a ticket for a specific day online before their visit. Without such a ticket, no admission will be granted. In such exceptional cases, we reserve the right to limit the number of tickets for a specific day for ResortPass holders to a quota set by us. A reservation possibility can therefore not be guaranteed. The reservations will be considered in the order in which they are received. 

(4) In the case of access restrictions due to public authorities or legislation, that the holder himself can affect (e.g. proof of vaccination, testing), the holder cannot claim any rights or damages against Europa-Park, if he cannot visit Europa-Park due to the failure to fulfil the personal requirements.

(5) If a holder reserves a ticket for a specific day, but does not use it, his or her possibility to reserve further tickets for the following 14 days may be restricted.

 

5. Loss of ResortPass annual passes

(1) In the event of the loss of vouchers and / or tickets, Europa-Park will only provide the booked service if the identity of the holder can be clearly ascertained and the voucher has not yet been used. There is no legal claim to redemption in this case.

(2) The loss of a printed ResortPass must be reported immediately to info@resort-pass.de. Holders are liable for the loss of their ResortPass. Generally, it is possible to obtain a replacement ticket for a fee.

 

6. Warranty and liability

(1) The statutory warranty rights shall be applicable for defects.

(2) The instructions of the staff of Europa-Park and Rulantica must be followed at all times within the parks and at the respective attractions with a view to ensuring safety. When attending an event, the terms and safety regulations of the respective event must be complied with.

(3) We shall be liable to you in all cases of contractual and non-contractual liability in the event of intent and gross negligence in accordance with statutory provisions for compensation for damages or reimbursement for wasted expenses.

(4) In other cases, we are only liable in the event of a breach of a contractual obligation, the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which you as the holder may regularly rely (so-called cardinal obligation), and limited to the compensation of the foreseeable and typical damage. In all other cases, our liability is excluded subject to the regulation in Para. 3.

(5) Our liability for damages from injury to life, limb or health and under the Product Liability Act (Produkthaftungsgesetz) remains unaffected by the above-mentioned limitations of liability and exclusions of liability.

(6) Complaints about faulty ResortPass annual passes must be made immediately after receipt of the e-mail or postal item. The complaint must be submitted in text form at info@resort-pass.de.

 

7. Applicable law and place of jurisdiction

(1) The law of the Federal Republic of Germany applies, with the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) We would like to point out that we are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

(3) If you are a merchant and have your registered office in Germany at the time of purchase, the exclusive place of jurisdiction is Freiburg im Breisgau. However, Europa-Park is also entitled to take legal action at the location of the holder's registered office or branch. Rust shall be the place of performance for all deliveries and payments. Otherwise, the applicable statutory provisions are valid for local and international jurisdictions.

(4) Should any provision of these terms and conditions and the other agreements made be or become invalid, this shall not affect the validity of the remaining terms and conditions.
